Terms of Use

1.1. These Terms of Use (the «Terms») govern the use of the online service Lavastyle, available on the website Lavastyle.ru, the website lava-style.ru, in the Telegram bot @lava_style_bot and in the VK mini app (the «Service»), provided by the Administration.

1.2. By using the Service, including starting the bot, registering, paying for services or gaining access to materials, the User confirms that they have fully read these Terms and accept them in full.

1.3. If the User disagrees with these Terms, the User must stop using the Service.

2.1. The Service provides access to digital goods and services of an intangible nature — processing of photos and videos using AI effects, as well as related information and support services.

2.2. Materials and effects provided through the Service may include:

• author AI effects and presets of the Administration;
• information and training materials;
• curated selections, recommendations and structured catalog data.

2.3. The User understands and agrees that the value of the digital goods and services lies in their systematization, analysis, presentation, support, maintenance and updates, rather than in the exclusivity of individual pieces of information.

2.4. The Service does not claim or guarantee the uniqueness, exclusivity or unavailability of individual elements of the materials outside the Service.

3.1. The Service is provided on an «as is» basis.

3.2. The Administration does not guarantee:

• that the Service will meet the User expectations;
• the achievement of any financial, commercial, professional or other results;
• uninterrupted and error-free operation of the Service.

3.3. The Administration is not liable for:

• any direct or indirect losses, including lost profits;
• the consequences of the User applying the received materials;
• actions or inaction of third parties;
• temporary technical failures and access restrictions.

3.4. All decisions on the use of materials, recommendations and services are made by the User independently and at the User own risk.

4.1. The Service is not intended to encourage, organize or facilitate unlawful activity.

4.2. The User undertakes to use the Service strictly within applicable law and the rules of third parties.

4.3. The User confirms that they hold the necessary rights to the uploaded photos and videos and do not violate the rights of third parties.

4.4. Responsibility for the lawfulness of using the materials and services of the Service rests entirely with the User.

5.1. All materials posted in the Service are protected by intellectual property law.

5.2. The User is prohibited from copying, distributing, reselling, transferring to third parties or otherwise using the materials of the Service without the permission of the rights holder.

5.3. Violation of intellectual property rights may result in restricted access to the Service without compensation.

6.1. The Administration may suspend or restrict the User access to the Service in the event of:

• violation of these Terms;
• detected abuse;
• requirements of the law or payment providers.

6.2. Restriction of access does not release the User from obligations that arose earlier.

6.3. The Administration reserves the right to refuse service to Users whose actions may create increased risks for the Service, payment providers or third parties.

7.1. Payment for services and digital goods is made on the terms specified in the Service before payment.

7.2. Due to the intangible nature of digital goods and services, no refunds are provided after access is granted, except in the cases listed below.

7.3. A refund is possible only if:

• the service was not provided due to a technical fault of the Service;
• access to the digital good was not actually granted.

7.4. To have a refund considered, the User must contact support within 24 hours of payment.

7.5. The refund decision is made by the Administration on a case-by-case basis.

7.6. The User confirms that they will not initiate a chargeback through payment systems without first contacting the Service support.

8.1. The Administration may collect the minimum necessary technical data to ensure the operation of the Service.

8.2. The processing of data is described in detail in the Privacy Policy available at lavastyle.ru/privacy-policy.

8.3. The Administration takes reasonable measures to protect data but does not guarantee absolute security of the transmitted information.

9.1. The Administration may amend these Terms.

9.2. The current version of the Terms is published in the Service.

9.3. Continued use of the Service constitutes acceptance of the updated terms by the User.
